ROMANIA – Meeting with the Minister of Justice

Strasbourg, Council of Europe - The Minister of Justice of Romania, Mr Tudorel Toader, met on 3 October with the Secretary of the Venice Commission, Mr Thomas Markert, and presented the envisaged Government Emergency Ordinance in the judicial field, which partly addresses issues raised in the Preliminary Opinion of the Venice Commission of 13 July 2018 (CDL-PI(2018)007).

The Secretary of the Commission welcomed the readiness of the Romanian Government to act upon some recommendations of the Preliminary Opinion and in particular the proposal to postpone sine die the entry into force of the envisaged new early retirement scheme for judges and prosecutors. He noted that the procedure proposed for the revocation of members of the Superior Council of Magistracy envisaged in the Ordinance was more in line with the Opinion of the Venice Commission but that in the Commission’s view this issue should be addressed by parliamentary legislation.
