Request for an amicus curiae brief - European Court of Human Rights

Strasbourg – Following the request of the European Court of Human Rights in the case of Mugemangango v. Belgium, the Venice Commission answered the following question:

"What are the adequate and sufficient procedural safeguards that a State must provide in the framework of a procedure for contesting the outcome of an election (notably in the event of allegations of irregularities during the electoral process) or the distribution of seats? In particular, what qualities should the body in charge of examining appeals on election results require?".

The amicus curiae brief was adopted by the Commission at its October 2019 plenary session.
